GENERAL TERMS AND CONDITIONS OF SALE

2. Purpose
These General Terms and Conditions of Sale (hereinafter referred to as the “GTC”) govern all sales made on the website [https://ferransanchezcastillo.be/], relating to artistic works, photographic prints, limited editions, or any other product offered for sale by the seller.
Any order implies full and unconditional acceptance of these GTC.
3. Products
The products offered for sale are described as accurately as possible.
Photographs, visuals, and descriptions are provided for illustrative purposes only and have no contractual value.
In the case of artistic works, minor variations (color, texture, finish) may occur and shall not be considered defects.
4. Prices
Prices are indicated in euros (€), all taxes included (VAT included), unless otherwise stated.
Shipping costs are not included in the price and are specified before order confirmation.
The seller reserves the right to modify prices at any time, without affecting orders already confirmed.
5. Orders
An order is considered final after:

validation of the shopping cart,

acceptance of the GTC,

and confirmation of payment.
The seller reserves the right to refuse or cancel any order in the event of a previous dispute with the customer or suspected fraud.
6. Payment
Payment is due immediately upon ordering.
Accepted payment methods include: [credit card, PayPal, bank transfer, etc.].
Transactions are secured by the payment service providers used.
7. Delivery
Products are delivered to the address provided by the customer at the time of ordering.
Delivery times are given for information purposes only and may vary depending on the destination and the nature of the product (unique artwork, print on demand, etc.).
The seller cannot be held responsible for delays attributable to carriers.
8. Right of Withdrawal
In accordance with applicable legislation, the customer has a period of 14 days from receipt of the product to exercise the right of withdrawal, except for legal exceptions.
⚠️ Exceptions:
The right of withdrawal does not apply to:

original artworks,

custom artistic shooting services,

personalized or made-to-order products,
-
signed or numbered prints produced on demand.
Returned items must be in their original condition. Return shipping costs are borne by the customer.
9. Liability
The seller shall not be held liable for indirect damages resulting from the use of the website or the products sold.
In any event, the seller’s liability is limited to the amount of the order.
10. Intellectual Property
All works, images, photographs, texts, and content displayed on the website are protected by copyright law.
The purchase of an artwork does not imply any transfer of reproduction or representation rights, unless expressly agreed in writing.
Any reproduction, distribution, or use without authorization is strictly prohibited.
11. Personal Data
Personal data collected are used solely for order processing and customer relationship management.
In accordance with the GDPR, customers have the right to access, rectify, and delete their data by contacting: [email].
12. Applicable Law and Disputes
These GTC are governed by Belgian law.
In the event of a dispute, an amicable solution will be sought prior to any legal action.
Failing that, the competent courts shall be those of the seller’s place of residence.
